These Terms and Conditions (“Terms”) govern your access to and use of the COVENANT website, online store, content, products, and related services collectively referred to as the “Services.”
The Services are operated by COVENANT LLC, doing business as COVENANT (“COVENANT,” “we,” “us,” or “our”).
By accessing our website, creating an account, placing an order, or otherwise using the Services, you agree to be bound by these Terms, our Privacy Policy, Return and Refund Policy, Shipping Policy, and any other policies displayed on our website.
Please read these Terms carefully before using the Services. If you do not agree with them, you should not access the website or use the Services.
1. ELIGIBILITY
You must be at least 18 years old, or the legal age of majority in your jurisdiction, to place an order through our website.
Individuals under the legal age of majority may use the Services only with the involvement and authorization of a parent or legal guardian.
By using the Services, you represent that you have the legal capacity and authority to enter into a binding agreement.
2. CHANGES TO THESE TERMS
We may update or modify these Terms from time to time to reflect changes to our business, website, products, practices, or legal obligations.
The updated version will be posted on this page with a revised “Last Updated” date. Unless otherwise stated, changes become effective when posted.
Your continued use of the Services after updated Terms are published constitutes your acceptance of those changes.
3. WEBSITE ACCESS AND ACCOUNTS
Certain features may allow or require you to create an account.
You agree to provide accurate, current, and complete information and to update it when necessary. You are responsible for maintaining the confidentiality of your login information and for all activity that occurs through your account.
You must notify us promptly if you believe your account has been accessed or used without authorization.
We reserve the right to suspend, restrict, or terminate an account when we reasonably believe that:
The account contains inaccurate or fraudulent information.
The account has been used for unauthorized or unlawful activity.
The user has violated these Terms.
Suspension or termination is necessary to protect COVENANT, our customers, or third parties.
4. PRODUCTS AND PRODUCT INFORMATION
COVENANT offers clothing, accessories, and other lifestyle products.
We make reasonable efforts to present product descriptions, photographs, measurements, materials, colors, sizing, availability, and other information as accurately as possible. However, we do not guarantee that every description or image will be completely error-free.
Colors may appear differently depending on your screen, device settings, lighting, and photography. Measurements may vary slightly because of manufacturing processes, garment washing, fabric composition, and the method used to measure each item.
Some COVENANT garments are designed with oversized, boxy, cropped, relaxed, straight, or baggy fits. Customers are responsible for reviewing the applicable product description and size guide before purchasing.
Minor variations in color, texture, placement, finishing, distressing, print, embroidery, washing, or construction may occur and do not necessarily constitute a defect.
5. PRODUCT AVAILABILITY AND LIMITED RELEASES
Certain COVENANT products may be released in limited quantities.
Adding an item to your cart does not reserve or guarantee that item. A product may become unavailable before checkout is completed.
We may limit the quantity of products available for purchase by an individual, household, account, payment method, billing address, shipping address, or order.
We reserve the right to discontinue, modify, restock, or decline to restock any product at any time without prior notice.
6. PREORDERS
Some products may be offered for preorder before they are ready to ship.
Estimated production and shipping dates displayed for preorder products are estimates and are not guaranteed delivery dates. Delays may occur because of production, quality control, transportation, customs, supply chain issues, or circumstances outside our reasonable control.
When purchasing a preorder item, you authorize us to charge your selected payment method according to the terms displayed during checkout.
Orders containing both preorder and in-stock items may be shipped together when all items are available or separately, depending on the shipping information displayed during checkout.
Any preorder cancellation or refund request will be handled according to the terms displayed on the product page and our Return and Refund Policy.
7. PRICES, TAXES, AND FEES
All prices are displayed in the currency identified on the website.
Prices may change without notice. A price change will not normally affect an order that we have already accepted, except when the displayed price resulted from an obvious technical, typographical, or administrative error.
Applicable sales tax, shipping charges, customs duties, import taxes, and other fees may be calculated and displayed during checkout when available.
Customers placing international orders are responsible for any customs duties, import taxes, brokerage charges, or other governmental fees imposed by the destination country unless the checkout page expressly states that those charges are included.
COVENANT is not responsible for delays caused by customs authorities or for a customer’s refusal to pay required import charges.
8. ORDERS AND ORDER ACCEPTANCE
Submitting an order does not automatically mean that the order has been accepted.
After you submit an order, you may receive an electronic confirmation acknowledging that we received it. This confirmation does not guarantee acceptance or shipment.
We reserve the right to accept, reject, limit, place on hold, or cancel an order for reasons including:
Product unavailability.
Pricing or product-description errors.
Suspected fraud or unauthorized payment activity.
Incorrect billing or shipping information.
Resale activity that we have not authorized.
Violation of these Terms.
Restrictions imposed by law, payment providers, shipping carriers, or governmental authorities.
If we cancel an order after payment has been processed, we will issue a refund to the original payment method for the canceled amount.
9. PAYMENT
You agree to provide valid, accurate, and complete billing and payment information.
Payments may be processed by third-party payment providers. Your use of a third-party payment method may also be governed by that provider’s terms and privacy practices.
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges, including the product price, taxes, shipping costs, and any other amounts disclosed during checkout.
We do not guarantee that every payment method will be available for every customer, location, or transaction.
10. SHIPPING AND DELIVERY
Shipping options, estimated processing times, rates, and delivery estimates will be displayed during checkout or in our Shipping Policy.
Delivery dates are estimates unless expressly stated otherwise. COVENANT is not responsible for delays caused by shipping carriers, severe weather, customs processing, address errors, transportation interruptions, labor disputes, natural disasters, or other events outside our reasonable control.
Customers are responsible for providing a complete and accurate shipping address. We are not responsible for orders delivered to an address that was entered incorrectly by the customer.
Once an order has been submitted, we cannot guarantee that the shipping address can be changed.
When tracking information indicates that an order was delivered but the customer cannot locate it, the customer should contact the shipping carrier and COVENANT as soon as possible.
Any claim involving a lost, stolen, damaged, or missing package must be submitted according to the procedures and deadlines stated in our Shipping Policy.
11. RETURNS, EXCHANGES, AND REFUNDS
Returns, exchanges, store credits, and refunds are governed by our separate Return and Refund Policy, which is incorporated into these Terms.
Before placing an order, you are responsible for reviewing that policy, including:
The applicable return period.
The required condition of returned merchandise.
Products that are marked final sale or are otherwise ineligible for return.
Return shipping responsibilities.
Exchange and store-credit procedures.
Refund processing times.
Original shipping charges are nonrefundable unless otherwise required by law or expressly stated in our Return and Refund Policy.
Products that have been worn, washed, altered, damaged, stained, scented, or returned without their original tags or packaging may be rejected when the Return and Refund Policy requires the merchandise to remain in original condition.
Nothing in these Terms limits any non-waivable consumer rights available under applicable law.
12. PROMOTIONS AND DISCOUNT CODES
Promotions, giveaways, discount codes, early-access offers, and special releases may be subject to additional rules.
Unless otherwise stated:
Promotions cannot be combined.
Discount codes have no cash value.
Discount codes cannot be applied to previous purchases.
Promotions may exclude limited releases, collaborations, gift cards, preorder products, or final-sale merchandise.
Only one discount code may be used per order.
Promotions may be modified or ended at any time before an eligible order is completed.
We may cancel or reject a promotion when we reasonably believe it has been used fraudulently, unlawfully, or contrary to its stated rules.
13. GIFT CARDS AND STORE CREDIT
Gift cards and store credits, when available, may be subject to additional terms displayed at the time of purchase or issuance.
Gift cards and store credits may not be exchanged for cash except where required by law.
Customers are responsible for protecting gift-card codes and account credentials. COVENANT is not responsible for unauthorized use resulting from a customer’s failure to protect that information, except where required by law.
14. INTELLECTUAL PROPERTY
The Services and their contents are owned by or licensed to COVENANT and are protected by applicable intellectual-property laws.
Protected materials may include:
The COVENANT name and logos.
Brand marks and symbols.
Product names and collection concepts.
Garment designs and artwork.
Photographs and videos.
Website graphics and layouts.
Written content and product descriptions.
Packaging and promotional materials.
Audio, animation, and other creative materials.
You may access the website for personal, noncommercial shopping and informational purposes.
You may not copy, reproduce, modify, distribute, publish, sell, license, create derivative works from, scrape, download, commercially exploit, or otherwise use COVENANT content without our prior written authorization.
Purchasing a product does not transfer ownership of any trademark, copyright, design, artwork, or other intellectual-property right associated with that product.
“COVENANT,” its logos, and related marks may not be used in a manner that suggests sponsorship, endorsement, affiliation, or authorization without our written permission.
15. COUNTERFEIT PRODUCTS AND UNAUTHORIZED RESALE
COVENANT products may not be reproduced, counterfeited, relabeled, materially altered for resale, or falsely represented as authentic COVENANT merchandise.
Purchases made primarily for unauthorized commercial resale may be limited or canceled.
Nothing in this section is intended to restrict lawful resale rights that cannot legally be waived.
16. REVIEWS, COMMENTS, AND USER CONTENT
You may have the opportunity to submit reviews, photographs, videos, comments, messages, tags, testimonials, or other content.
You retain ownership of content you create. However, when you voluntarily submit content directly to COVENANT or authorize us to use content in which you have tagged or mentioned COVENANT, you grant us a nonexclusive, worldwide, royalty-free license to use, reproduce, display, adapt, publish, and share that content for website, social-media, advertising, promotional, and brand-communication purposes.
You represent that:
You own the content or have permission to submit it.
The content does not violate another person’s intellectual-property, privacy, publicity, or other rights.
The content is accurate to the best of your knowledge.
Any material relationship, payment, gift, or incentive connected to the content has been properly disclosed.
The content does not contain unlawful, threatening, defamatory, hateful, deceptive, obscene, or malicious material.
We may moderate or remove user content that violates these Terms, but we are not obligated to monitor every submission.
Nothing in these Terms prohibits customers from providing honest reviews or opinions about COVENANT, its products, or its services.
17. PROHIBITED USES
You may not use the Services:
For unlawful, fraudulent, deceptive, or abusive purposes.
To violate another person’s rights.
To impersonate another person or misrepresent your identity.
To submit false payment, billing, shipping, or account information.
To introduce malware, viruses, malicious code, or harmful technology.
To interfere with the website’s security, operation, servers, or networks.
To gain unauthorized access to an account, system, database, or restricted area.
To scrape, crawl, harvest, collect, or extract data without written authorization.
To use automated systems to purchase limited products or interfere with product availability.
To circumvent product limits, security controls, or fraud-prevention measures.

To engage in activity that could damage COVENANT, its customers, or third parties.

COVENANT does not control and is not responsible for the content, availability, security, accuracy, products, services, policies, or practices of third parties.
Accessing a third-party service is at your discretion and may be subject to separate terms and privacy policies.
The presence of a third-party link does not necessarily mean that COVENANT sponsors, endorses, or guarantees that third party.
19. PRIVACY
Our collection, use, storage, and disclosure of personal information are described in our Privacy Policy.
By using the Services, you acknowledge that you have had the opportunity to review our Privacy Policy.
The Privacy Policy should be read together with these Terms but remains a separate policy.
20. ELECTRONIC COMMUNICATIONS
By using the Services or contacting us electronically, you consent to receive transactional communications related to your account, orders, payments, shipping, returns, security, and customer-support requests.
Marketing emails or text messages will be sent only as permitted by applicable law and according to the consent provided.
You may unsubscribe from marketing communications using the instructions included in the applicable message. Unsubscribing from marketing messages will not prevent us from sending necessary transactional or service-related communications.
Message and data rates may apply to text messages depending on your mobile provider and plan.
21. WEBSITE AVAILABILITY
We aim to maintain reliable access to the Services, but we do not guarantee that the website will always be available, secure, accurate, uninterrupted, or free from technical errors.
We may modify, suspend, restrict, or discontinue all or part of the Services for maintenance, security, operational, legal, or business reasons.
We are not responsible for losses caused solely by temporary website unavailability, except where liability cannot legally be excluded.
22. DISCLAIMER OF WARRANTIES
To the fullest extent permitted by applicable law, the Services and website content are provided on an “as is” and “as available” basis.
COVENANT does not make warranties or representations that:

Every website defect will be corrected immediately.
The website will be free from viruses or harmful components.
Website content will always be complete, current, or perfectly accurate.
Products will satisfy preferences or expectations that were not included in the applicable product description.
This disclaimer does not exclude warranties or rights that cannot be excluded under applicable law.
23. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, COVENANT and its owners, officers, employees, contractors, representatives, licensors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from or related to the Services, products, website, or these Terms.
This may include loss of profits, revenue, data, business opportunities, goodwill, or anticipated savings.
To the fullest extent permitted by applicable law, COVENANT’s total liability for a claim relating to a product or order will not exceed the amount paid to COVENANT for the product or order giving rise to that claim.
These limitations do not apply to liability that cannot legally be limited or excluded, including liability resulting from fraud, intentional misconduct, or any other matter for which limitation is prohibited by law.
Some jurisdictions do not allow certain warranty exclusions or limitations of liability. In those jurisdictions, the limitations will apply only to the maximum extent legally permitted.
24. INDEMNIFICATION
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless COVENANT and its owners, officers, employees, contractors, representatives, licensors, and service providers from third-party claims, liabilities, losses, damages, judgments, and reasonable expenses arising from:
Your unlawful or unauthorized use of the Services.
Your material violation of these Terms.
Content you submit through the Services.
Your infringement or violation of another person’s rights.
Fraudulent or intentionally harmful activity conducted through your account.
This section does not require you to indemnify COVENANT for claims caused solely by COVENANT’s own unlawful conduct, gross negligence, or intentional misconduct.
25. FORCE MAJEURE
COVENANT will not be responsible for a delay or failure caused by circumstances outside its reasonable control.
Such circumstances may include natural disasters, severe weather, fire, flood, epidemic, pandemic, war, terrorism, civil unrest, labor disputes, power outages, cyberattacks, transportation interruptions, carrier delays, customs delays, supply shortages, manufacturing interruptions, governmental actions, or changes in law.
We will make reasonable efforts to resume the affected Services or fulfill accepted orders when circumstances permit.
26. GOVERNING LAW
These Terms and any dispute arising from or relating to the Services or a purchase from COVENANT will be governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Nothing in this section deprives a consumer of any mandatory protection provided by the laws of the jurisdiction in which the consumer resides.
27. JURISDICTION AND VENUE
Unless applicable law requires otherwise, any legal proceeding arising from or relating to these Terms, the Services, or a purchase from COVENANT must be brought in a state or federal court located in Miami-Dade County, Florida.
You and COVENANT consent to the personal jurisdiction of those courts.
28. INFORMAL DISPUTE RESOLUTION
Before filing a legal claim, you agree to contact COVENANT and make a reasonable, good-faith effort to resolve the dispute informally.
Your notice should include:
Your full name.
Your order number, when applicable.
A description of the dispute.
Relevant supporting information.
The resolution you are requesting.
Notices may be sent to [CUSTOMER-SERVICE EMAIL].
This section does not prevent either party from requesting urgent relief when necessary to prevent immediate or irreparable harm.
29. SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law or removed to the minimum extent necessary.
The remaining provisions will remain in effect.
30. NO WAIVER
A failure by COVENANT to enforce any provision of these Terms does not waive our right to enforce that provision later.
A waiver will be effective only when it is made in writing by an authorized representative of COVENANT.
31. ASSIGNMENT
You may not transfer or assign your rights or obligations under these Terms without our prior written consent.
COVENANT may assign or transfer its rights and obligations as part of a merger, acquisition, sale of assets, corporate reorganization, financing transaction, or transfer of the business, subject to applicable law.
32. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy, and any additional terms displayed during a purchase or promotion, constitute the entire agreement between you and COVENANT concerning the Services.
If additional terms conflict with these Terms, the additional terms will control only for the product, promotion, or service to which they expressly apply.
